End User License Agreement

1. Agreement and parties

This End User License Agreement (the “Agreement”) is between you and AIChessGM LLC (“AIChessGM,” “we,” or “us”). It applies to the AIChessGM macOS application, its included documentation, and AIChessGM 1.x updates we provide (together, the “Software”).

By installing, activating, or using the commercial Software, you accept this Agreement. If you do not accept it, do not activate or use the commercial Software.

2. License grant

Subject to this Agreement and payment of the applicable price, AIChessGM grants one named individual a limited, non-exclusive, non-transferable license to install and use AIChessGM 1.x on up to two Macs activated at the same time.

The one-time AIChessGM 1.x purchase includes updates we release within the 1.x major-version family. It does not include ownership of the Software, a promise of a future 2.x or later release, or a promise that future major releases or optional online services will be free.

You may make a reasonable backup copy for your own use. Business or organizational licensing, redistribution, resale, rental, sublicensing, or sharing a license key with another person requires written permission from AIChessGM.

3. Trial, activation, and validation

• A new eligible production installation receives a 30-day trial. Existing preview installations keep the trial expiry already shown to them; installing an update does not reset the trial.
• Paid activation requires an internet connection and a valid provider-issued license key. The license permits two active Macs.
• When possible, deactivate an old Mac in Settings → License before activating a replacement. Support can assist if the old Mac is unavailable.
• The Software may validate a paid license after activation, normally no more than once in a 24-hour period. This check is designed not to block normal startup.
• During the first 30 days after activation, the Software allows a seven-day offline grace period after a successful validation.
• After a successful validation at least 30 days after activation, that installation receives durable offline access. Failure to contact Lemon Squeezy after that point does not remove paid capabilities. A confirmed refund, chargeback outcome, disabled license, or other authoritative revocation still ends the paid entitlement.

AIChessGM uses a random installation identifier for licensing and does not create a hardware fingerprint.

4. Restricted mode and customer data

When a trial expires or a paid entitlement cannot remain active, AIChessGM enters Restricted mode. Restricted mode preserves access to open, view, and export local chess data, along with license recovery and Help. Premium mutation, engine, AI, training, and generated-media capabilities may be unavailable until the Software is activated again.

Your chess files and authored content remain yours. You are responsible for maintaining backups. AIChessGM does not take ownership of your databases, games, opening trees, annotations, or exported media.

5. Use restrictions

You may not:

• copy, distribute, publish, sell, sublicense, rent, or provide the Software or a license key to another person except as this Agreement expressly allows;
• bypass, disable, or interfere with activation, validation, activation limits, Restricted mode, or other license controls;
• reverse engineer, decompile, or disassemble the Software except to the limited extent that applicable law expressly permits despite this restriction;
• use the Software unlawfully or to infringe another person’s rights; or
• remove proprietary notices from the Software or documentation.

6. Optional third-party services

AIChessGM can connect to optional chess engines, artificial-intelligence providers, speech services, remote-compute services, websites, and other tools that you choose and configure. Those services are provided under their own terms and privacy policies. Their accounts, API usage, subscriptions, hardware, and network charges are not included in the AIChessGM purchase price.

AI, engine, database, and internet-research output can be incomplete or wrong. Review important analysis and preserve original data before making changes.

7. Updates and support

We intend to acknowledge customer support messages within two U.S. business days. This is an operating target, not a guaranteed service level. The included 1.x update commitment does not require us to maintain every optional third-party integration indefinitely when a provider changes or ends its service.

8. Termination

This license ends if you materially breach this Agreement and do not cure the breach after notice when a cure is reasonably possible. A completed refund or a provider-confirmed payment reversal also ends the paid entitlement. When the entitlement ends, you must stop using paid features, but Restricted mode remains available to open, view, and export local chess data.

9. Warranty disclaimer

To the maximum extent permitted by law, the Software is provided “as is” and “as available.” AIChessGM disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Software or third-party services will always be available, uninterrupted, error-free, or suitable for a particular chess, training, publishing, or competitive decision.

Some jurisdictions do not allow certain disclaimers. Nothing in this Agreement excludes a warranty or consumer right that applicable law does not allow us to exclude.

10. Limitation of liability

To the maximum extent permitted by law, AIChessGM will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, or lost data. AIChessGM’s total liability arising from the Software will not exceed the amount you paid for the license that gave rise to the claim.

This limitation does not apply where applicable law does not permit it, including liability that cannot legally be limited or excluded.

11. General terms

If part of this Agreement is unenforceable, the remaining parts remain effective. A failure to enforce a term is not a waiver. You may not transfer this Agreement without our written consent; we may transfer it as part of a merger, reorganization, or sale of the Software business, subject to applicable law.

We may update this Agreement for future Software versions or material service changes. The version presented with your licensed release governs unless a later change is accepted or applicable law requires otherwise.
